Classification Of Unregistered Trademarks

According to the provisions of the Trademark Law on trademark registration procedures,

According to the use of trademarks and the popularity of the relevant public, unregistered trademarks can be classified into well-known trademarks and non well-known trademarks. According to the Trademark Law of China, well-known trademarks are not limited to registered trademarks.

In judicial practice, the unregistered trademark has been recognized as a well-known trademark.

According to the right attribute of trademark itself, unregistered trademarks can be divided into unregistered trademarks with exclusive rights and unregistered trademarks without exclusive rights.

For example, the trademark pattern itself belongs to the trademark of creative copyright works, or the text or pattern that constitutes a trademark belongs to the name and decoration of the well-known commodity, or the trademark pattern itself has the right of portrait, that is, the trademark itself carries certain exclusivity.

An unregistered trademark without exclusionary rights does not have the above.
