Trademark objection is

The legal procedures for publicly soliciting public opinions on the preliminary examination and approval of trademarks are clearly stipulated by the rules of implementation, and the purpose of the procedures is to make fair and open trademark confirmation and improve the quality of trademark registration examination.


The content of trademark objection is very wide, including the initial approval of the trademark, which is the same or similar with the original trademark, also includes the preliminary approval of the trademark, which violates the prohibition clause or trademark of the trademark law.


A trademark objection may be a person, that is, a trademark registrant, or a non trademark registrant. It can be an enterprise, a public institution, or an individual. It can be either a legal person or an unincorporated entity.

Fill out the "trademark objection", fill in the name of the objected trademark, the category of commodities, the initial approval number, the initial approval notice number, and the reasons for objection.

If a trademark is considered to be the same or similar to the trademark that the dissenter has registered in the same or similar commodity, the commodity category, trademark name and registration number of the dissenter's registered trademark should also be filled.


Three. Objection handling procedures


1. After receiving the letter of objection and relevant evidence, the Trademark Office shall send a copy of the objection to the applicant for trademark registration by the dissenter. The objection shall make a written reply within fifteen days from the date of receiving the objection.

If a dissenter fails to make a reply within the time limit, he shall be regarded as abstaining from voting and shall not affect the objection procedure.


2. The Trademark Office shall make an objection order after investigating and verifying the facts and reasons raised by the dissenters and the dissenters.


Four. Result of adjudication


The Trademark Office shall send the objection order to the dissenter and the dissenter after making an objection ruling.

There are two results of adjudication.


1, the reason for objection can not be established, and the trademark that has been preliminarily approved will be registered.


2, the reasons for objection are sufficient, and objection is established. The original registered trademark will not be registered.


However, if any party in the objection party is not satisfied with the ruling, he may apply for trademark review within fifteen days from the date of receiving the objection notice. The trademark application registration shall be pferred to the application stage for trademark objection.
