Foreign Trade Common Sense Anti-Dumping

What is?

Anti-dumping

?

World Trade Organization

"

Anti dumping agreement

"A member must abide by three conditions to implement anti-dumping measures:

First, determine the facts of dumping.

Second, determine the threat of substantial damage or substantial damage to the industry, or cause substantial obstacles to the establishment of related industries.

Third, there is a causal relationship between dumping and injury.

According to the definition of dumping, if the price of the product is lower than the normal price, it will be considered dumping.

The difference between the price below the normal price is known as the dumping margin.

Therefore, the determination of dumping must take three steps: determining the price, determining the normal price, and comparing the price with the normal price.

Normal prices usually refer to comparable prices of similar products under general conditions.

If the price of the product is controlled, the normal price is often recognized by the price of the same kind of products of the third country.

Unlike the initiation of countervailing investigations, the injured country has no obligation to consult with its members before the anti-dumping investigation is initiated. When examining the impact of dumping on the industry, the magnitude of the dumping margin should be considered and the dumping margin should be determined.

The WTO stipulates that the dumping margin should not exceed 2% of the price, and the dumping product volume does not exceed 3% of the same product proportion.

The ultimate remedy for anti-dumping is to impose anti-dumping duties on dumped products.

The amount of anti-dumping duty can be equal to the dumping margin or the dumping margin.

Despite the fact that the anti-dumping investigation is not over, the dumping has been preliminarily ruled out and the damage it has caused, and that the dumping continues to cause damage in the course of the investigation, and the parties have been fully provided with the opportunity to express their opinions, and the injured members can take temporary measures.

Another remedy is price commitment.

If the supplier voluntarily made a satisfactory commitment to modify the price or stop dumping price, the investigation procedure may be suspended or terminated, and the departments concerned shall not take temporary measures or impose anti-dumping duties.

Like the launching of countervailing investigation procedures, a member government should initiate anti-dumping investigations after receiving applications from enterprises or industries that are damaged by dumping products.

The parties must be informed of the initiation of the investigation.

They include members of the government, businessmen or overseas students.
